TimeDesign Standard License
This license applies to the Registered version of TimeDesign. If you do not have a Registered version of TimeDesign, see the section below titled TimeDesign Evaluation License.
Your agreement to this license
You should carefully read the following terms and conditions before using this software. Unless you have a different license agreement signed by Onyx Computer Systems cc. ("OCS") your use, distribution, or installation of this copy of TimeDesign indicates your acceptance of this License.
By using, copying, transmitting, distributing or installing TimeDesign, you agree to all of the terms of this License. If you do not agree to all of the terms of this License, then do not use, copy, transmit, distribute, or install TimeDesign.
Scope of license
This copy of TimeDesign may be used by only by the training institution that purchased it. You may have as many copies as you require within your institution or on the persons from that institution that require it. You may not use it to provide a service to other training institutions or individuals. You may this distribute this version of TimeDesign to others excluding your Registration information. Unless you have prior written authorisation from OCS, you are not authorised to distribute your Registration information to others.
All rights of any kind in TimeDesign which are not expressly granted in this License are entirely and exclusively reserved to and by OCS. You may not rent, lease, modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on, TimeDesign. You may not make access to TimeDesign available to others in connection with a service bureau, application service provider, or similar business.
Warranty disclaimers and liability limitations
This software, and all accompanying files, data, and materials are distributed "as is", and with no warranties of any kind, whether expressed or implied. Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it. The user must assume the entire risk of using the program. This disclaimer of warranty constitutes and essential part of this license agreement.
TimeDesign attempts to resolve timetable schedules as best possible. Given the near limitless combinations, there is no warranty that
TimeDesign will be able to provide a solution to your timetable, but there is an extremely high probability that you will get a solution.
Any Liability of OCS will be limited exclusively to refund of purchase price, in addition, in no event shall OCS, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organisations, be liable for any incidental, consequential, or punitive damages whatsoever relating to the use of TimeDesign, or to your relationship with OCS.
In addition, in no event, does OCS authorise you to use TimeDesign in applications or systems where TimeDesign's failure to perform, can reasonably be expected to result in a significant physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold OCS harmless from any claims or losses relating to such unauthorised use.
General
This Agreement is the complete statement of the Agreement between the parties on the subject matter, and merges and supersedes all
other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by the laws of the Republic of South Africa. Exclusive jurisdiction and venue for all matters relating to this Agreement shall be in courts located in the Republic of South Africa, and you consent to such jurisdiction and venue. There are no third party beneficiaries of any promises, obligations or representations made by OCS herein.
TimeDesign Evaluation License
This license applies to the evaluation version of TimeDesign. If you do not have an evaluation version of TimeDesign, see the section above titled TimeDesign Standard License.

This is not free software. Subject to the terms below, you are hereby licensed by Onyx Computer Systems. ("OCS") to use this software for evaluation purposes without charge for a period of 21 days. If you use this software after the 21 day evaluation period a registration fee of R1099.00 (ZAR) is required. Payments must be in South African Rands drawn on a South African Bank, and should be sent to Onyx Computer Systems cc., P.O. Box 19135, Fishers Hill, 1401, Germiston, Gauteng, South Africa. See the TimeDesign web site at http://www.onyxsa.co.za for information about online ordering and quantity discounts.
Unregistered use of TimeDesign after the 21-day evaluation period is in violation of South African and international copyright laws.
